Wall Street jumps as banks lead indexes to new highs

NEW YORK (Reuters) - Stocks rallied to fresh highs on Tuesday as investors picked up large-cap companies' shares on the expectation that central bank stimulus will help propel the rally further.

Gains were broad, but growth sectors outperformed their peers with bank stocks leading the way. Bank of America , up 2.8 percent at $13.34, was the Dow's biggest percentage gainer, while Citigroup Inc rose 2.4 percent to $50.09.

Wall Street has rallied without a significant correction since the start of the year, pushing major indexes to all-time records and sending the S&P 500 up almost 16 percent for 2013 so far.

The ascent has been driven in large part by the Federal Reserve's easy monetary policy, designed to stimulate the economy, though investors' focus has turned to when the Fed may start to rein in its bond-purchase program.

"The developed economies of the world are all easing aggressively, the money is looking for a home, and it's ending up in the stock markets," said Bucky Hellwig, senior vice president at BB&T Wealth Management in Birmingham, Alabama.

For now, investors are betting that the central bank will be careful not to remove its support too soon in order to not disrupt the economic recovery it is trying to foster, Hellwig said.

So far, declines in the market have been met with buying and investors are trying to gauge how long that can last.

"People are indeed trying to participate in the rally, but at the same time, they're trying to be cautious," said Brad McMillan, chief investment officer of Commonwealth Financial, based in Waltham, Massachusetts.

The S&P 500 financial sector index <.spsy> rose 1.7 percent, while the S&P transports group index <.splrctrn> gained 1.4 pct.

The Dow Jones industrial average <.dji> gained 123.57 points, or 0.82 percent, to close at a record 15,215.25. The Standard & Poor's 500 Index <.spx> rose 16.57 points, or 1.01 percent, to end at a record 1,650.34. The Nasdaq Composite Index <.ixic> climbed 23.82 points, or 0.69 percent, to 3,462.61, its highest close since November 2000.

During the session, the Dow hit an all-time intraday high of 15,219.55, while the S&P 500 climbed to an all-time intraday high of 1,651.10.

The Nasdaq touched a fresh 52-week high of 3,468.67.

The market had traded sideways for the past three sessions, showing a gain of just 0.07 percent as the winding down of the quarterly earnings season and a light economic calendar have left investors without a strong catalyst for further gains.

The Dow's gains were limited by weakness in Intel Corp , down 1 percent at $23.84, and UnitedHealth Group , off 1.1 percent at $61.73.

U.S.-listed shares of Sony Corp jumped 9.9 percent to $20.76 after billionaire hedge fund investor Daniel Loeb called on the company to spin off its lucrative entertainment arm.

Nokia Corp unveiled a new version of its Lumia smartphone line, but U.S.-listed shares fell 5.2 percent to $3.64. Research company Gartner said Nokia lost 5 percentage points of market share in the first quarter, falling to 14.8 percent.

Solar power companies' shares fell after Trina Solar Ltd estimated lower panel shipments than a previous outlook and said its results would be hurt by a foreign currency exchange loss. The stock fell 8.8 percent to $5.41, while Yingli Green Energy slid 6.3 percent to $2.36.

Most corporate earnings have been better than expected this quarter. With 90 percent of the S&P 500 companies having reported results so far, 67.2 percent have topped earnings expectations, according to Thomson Reuters data, which is even with the average over the past four quarters. However, only 46.9 percent have beaten revenue expectations, below the 52 percent average over the past four quarters.

Volume was roughly 6.2 billion shares on the New York Stock Exchange, the Nasdaq and the NYSE MKT, just below the average daily closing volume of about 6.4 billion this year.

Advancers outnumbered decliners on the NYSE by a ratio of about 2 to 1, while on the Nasdaq, more than two stocks rose for every one that fell.

Passenger car drivers are more likely to die in crashes with SUVs, regardless of crash ratings

May 14, 2013 ? Most consumers who are shopping for a new car depend on good crash safety ratings as an indicator of how well the car will perform in a crash. But a new University at Buffalo study of crashes involving cars and sport utility vehicles (SUVs) has found those crash ratings are a lot less relevant than vehicle type.

The study is being presented May 16 at the annual meeting of the Society of Academic Emergency Medicine in Atlanta.

In head-on collisions between passenger cars and SUVs, the UB researchers found that drivers in passenger cars were nearly 10 times more likely to die if the SUV involved had a better crash rating. Drivers of passenger cars were more than four times more likely to die even if the passenger car had a better crash rating than the SUV.

"When two vehicles are involved in a crash, the overwhelming majority of fatalities occur in the smaller and lighter of the two vehicles," says Dietrich Jehle, MD, UB professor of emergency medicine at Erie County Medical Center and first author.

"But even when the two vehicles are of similar weights, outcomes are still better in the SUVs," he says, "because in frontal crashes, SUVs tend to ride over shorter passenger vehicles, due to bumper mismatch, crushing the occupant of the passenger car."

When crash ratings were not considered, the odds of death for drivers in passenger cars were more than seven times higher than SUV drivers in all head-on crashes. In crashes involving two passenger cars, a lower car safety rating was associated with a 1.28 times higher risk of death for the driver and a driver was 1.22 times more likely to die in a head-on crash for each point lower in the crash rating.

The UB researchers conducted the retrospective study on severe head-on motor vehicle crashes in the Fatality Analysis Reporting System (FARS) database between 1995 and 2010. The database includes all motor vehicle crashes that resulted in a death within 30 days and includes 83,521 vehicles involved in head-on crashes.

"Along with price and fuel efficiency, car safety ratings are one of the things that consumers rely on when shopping for an automobile," says Jehle. These ratings, from one to five stars, are based on data from frontal, side barrier and side pole crashes that compare vehicles of similar type, size and weight. The one to five star safety rating system was created in 1978 by the National Highway Traffic Safety Administration.

Jehle notes that after manufacturers addressed the roll-over problem with SUVs that plagued these vehicles in the 1980s and 1990s, rollover crashes are now much less common in SUVs.

"Currently, the larger SUVs are some of the safest cars on the roadways with fewer rollovers and outstanding outcomes in frontal crashes with passenger vehicles," he says.

Jehle says that prior studies on frontal crashes have found that compared to passenger cars with a 5-star crash rating, cars with a rating from one to four stars have a 7-36% increase in driver death rates.

"Passenger vehicles with excellent safety ratings may provide a false degree of confidence to the buyer regarding the relative safety of these vehicles as demonstrated by our findings," says Jehle. "Consumers should take into consideration the increased safety of SUVs in head-on crashes with passenger vehicles when purchasing a car."

Invasion of the slugs; Halted by worms

May 12, 2013 ? The gardener's best friend, the earthworm, is great at protecting leaves from being chomped by slugs, suggests research in BioMed Central's open access journal BMC Ecology. Although they lurk in the soil, they seem to protect the plants above ground. Increasing plant diversity also decreases the amount of damage slugs do to individual plants.

Spanish slugs (Arion vulgaris) are among the top 100 worst alien species in Europe and are considered a pest almost everywhere. A team of scientists from the University of Natural Resources and Life Sciences Vienna investigated what effect the presence of earthworms and plant diversity would have on the amount of damage these slugs caused.

Using large incubators to simulate grassland environments the researchers could regulate the diversity of plant species and time the introduction of earthworms and slugs. They found that the presence of worms increased nitrogen content of plants and reduced the number of leaves damaged due to slugs by 60%. Yet when they compared leaf area damaged the researchers found slugs also ate 40% less at high plant diversity than at low.

Explaining their results Dr Johann Zaller, who led the study, said, "Our results suggest that two processes might be going on. Firstly, earthworms improved the plant's ability to protect itself against slugs perhaps through the build-up of nitrogen-containing toxic compounds. Secondly, even though these slugs are generalists they prefer widely available food and in high diverse ecosystems slugs eat less in total because they have to switch their diets more often since plants of the same species are less available. Therefore gardeners are to help protect earthworms by increasing plant diversity in the garden in order to keep slug damage low. In order to elucidate the mechanisms behind these complex interactions, all parts of an ecosystem need to be investigated."

CBOE keeps index franchise as justices stay out of dispute

WASHINGTON (Reuters) - CBOE Holdings Inc won a long-running legal battle to prevent rival International Securities Exchange from listing options on two key U.S. stock-market indexes, after the U.S. Supreme Court on Monday declined to consider their dispute.

The court's refusal to intervene leaves intact a lower court ruling that allows CBOE, the operator of the oldest and biggest U.S. stock market, to remain the sole market for options on the Standard & Poor's 500 Index and the Dow Jones Industrial Average.

CBOE's exclusive franchise on stock-index options is a lucrative one, generating 60 percent of CBOE's transaction fees, although they account for less than 40 percent of its trading volume.

"We are vindicated after more than six years of lengthy and unnecessary litigation that the highest court in the land has validated our position and the intellectual property rights of index providers," CBOE's chief executive and chairman, William Brodsky, said in a statement.

An ISE spokeswoman had no immediate comment. CBOE shares were up about 0.7 percent on the Nasdaq stock market, to $39.57, after earlier touching an all-time high.

International Securities Exchange LLC (ISE) was fighting an injunction that prevented it from listing S&P 500 and Dow Jones options, which are licensed exclusively to S&P Dow Jones Indices LLC, a joint venture of McGraw-Hill Companies Inc. and CME Group Inc. .

S&P Dow Jones has exclusive licensing agreements with the Chicago Board Options Exchange. In March this year, CBOE extended its contract until 2033.

ISE, a unit of Deutsche Boerse AG , claimed that CBOE effectively had a monopoly on what ISE's lawyers describe as "widely disseminated facts and ideas" that are not protected under the Copyright Act.

In 2006, ISE said it would start offering its own index options based on the two indexes without obtaining a license, prompting CBOE, CME and McGraw-Hill to sue.

In a 2012 decision, an Illinois appeals court upheld a lower court ruling against ISE.

The appeals court decided the case under Illinois state law, rejecting ISE's claims that the dispute should be decided under the federal Copyright Act.

The case is International Securities Exchange v. Chicago Board Options Exchange, U.S. Supreme Court, No. 12-940.

The fin whale is the second-largest animal ever to live on Earth. It is also, paradoxically, one of the least understood. The animal's huge size and global range make its movements and behavior hard to study.

A carcass that washed up on a Seattle-area beach this spring provided a reminder that sleek fin whales, nicknamed "greyhounds of the sea," are vulnerable to collision when they strike fast-moving ships. Knowing their swimming behaviors could help vessels avoid the animals. Understanding where and what they eat could also help support the fin whale's slowly rebounding populations.

University of Washington oceanographers are addressing such questions using a growing number of seafloor seismometers, devices that record vibrations. A series of three papers published this winter in the Journal of the Acoustical Society of America interprets whale calls found in earthquake sensor data, an inexpensive and non-invasive way to monitor the whales. The studies are the first to match whale calls with fine-scale swimming behavior, providing new hints at the animals' movement and communication patterns.

The research began a decade ago as a project to monitor tremors on the Juan de Fuca Ridge, a seismically active zone more than a mile deep off the Washington coast. That was the first time UW researchers had collected an entire year's worth of seafloor seismic data.

"Over the winter months we recorded a lot of earthquakes, but we also had an awful lot of fin-whale calls," said principal investigator William Wilcock, a UW professor of oceanography. At first the fin whale calls, which at 17 to 35 vibrations per second overlap with the seismic data, "were kind of just a nuisance," he said.

In 2008 Wilcock got funding from the Office of Naval Research to study the previously discarded whale calls.

Dax Soule, a UW doctoral student in oceanography, compared the calls recorded by eight different seismometers. Previous studies have done this for just two or three animals at a time, but the UW group automated the work to analyze more than 300,000 whale calls.

The method is similar to how a smartphone's GPS measures a person's location by comparing paths to different satellites. Researchers looked at the fin whale's call at the eight seismometers to calculate a position. That technique let them follow the animal's path through the instrument grid and within 10 miles of its boundaries.

Soule created 154 individual fin whale paths and discovered three categories of vocalizing whales that swam south in winter and early spring of 2003. He also found a category of rogue whales that traveled north in the early fall, moving faster than the other groups while emitting a slightly higher-pitched call.

"One idea is that these are juvenile males that don't have any reason to head south for the breeding season," Soule said. "We can't say for sure because so little is known about fin whales. To give you an idea, people don't even know how or why they make their sound."

The fin whale's call is not melodic, but that's a plus for this approach. The second-long chirp emitted roughly every 25 seconds is consistently loud and at the lower threshold of human hearing, so within range of earthquake monitoring instruments. These loud, repetitive bleeps are ideally suited for computer analysis.

Michelle Weirathmueller, a UW doctoral student in oceanography, used Soule's triangulations to determine the loudness of the call. She found the fin whale's call is surprisingly consistent at 190 decibels, which translates to 130 decibels in air about as loud as a jet engine.

Knowing the consistent amplitude of the fin whale's song will help Weirathmueller track whales with more widely spaced seismometer networks, in which a call is recorded by only one instrument at a time. Those include the Neptune Canada project, the U.S. cabled observatory component of the Ocean Observatories Initiative, and the huge 70-seismometer Cascadia Initiative array that's begun to detect tremors off the Pacific Northwest coast.

"We'd like to know where the fin whales are at any given time and how their presence might be linked to food availability, ocean conditions and seafloor geology," Weirathmueller said. "This is an incredibly rich dataset that can start to pull together the information we need to link the fin whales with their deep-ocean environments."
